CerTracker Terms of Use

CerTracker provides a secure and efficient platform for healthcare professionals, training programs, and employers to upload, track, and manage certifications, continuing education (CE) credits, and credentials. The platform allows users to create a digital fingerprint for each document, enabling quick and reliable verification by employers and reducing administrative delays in the credentialing process.

To use CerTracker, you must register and create a User Account. By registering, you represent and warrant that:

• You are at least 18 years old and legally authorized to enter into contracts under applicable law;
• Your registration data is true, accurate, current, and complete, and you will keep it updated;
• You are authorized to create a User Account (for yourself or, where you are legally empowered, on another person's behalf);
• You agree to our Privacy Policy and are legally authorized to view information accessible through the Services.

This agreement is void where prohibited by law.

CerTracker reserves the right to update these Terms at any time. If we make significant changes, we will notify you by posting the new Terms on the platform or by email. Continued use of the Services after notification means you agree to the revised Terms.

CerTracker owns the Services, including all content and functionality you access through the platform. Subject to your compliance with these Terms, CerTracker grants you a non-exclusive, non-sublicensable, revocable, non-transferable license to use the Services.

You own your Personal Data and any other content you submit through the Services ("Content"). As a condition of providing the Services, you grant CerTracker a perpetual, non-exclusive, royalty-free, worldwide license to use your Content for the purpose of providing the Services, subject to the restrictions in the Privacy Policy.

You may use the Services only for lawful purposes. You shall not:

• Provide false, misleading, or inaccurate information;
• Access content or systems you are not authorized to access;
• Violate any applicable law or regulation, including export controls;
• Probe, scan, or test the vulnerability of the platform without authorization;
• Interfere with the platform via malicious code, flooding, or other technical means;
• Post unsolicited advertising, spam, or harmful content;
• Infringe intellectual property, privacy, or publicity rights;
• Reverse-engineer, decompile, or attempt to extract source code;
• Encourage or enable any of the above.

You are solely responsible for maintaining the confidentiality of your User Credentials and for any activities under your account. Notify us immediately of any unauthorized use. CerTracker will not be liable for losses arising from credential compromise that was within your control.

We respect your privacy. Please see our Privacy Policy for an explanation of what we collect and how we use it. By accepting these Terms, you affirm that the Privacy Policy is part of these Terms.

You are responsible for obtaining and maintaining the systems necessary to access the Services, including internet service, modern web browsers, and reasonable security software. There are inherent risks associated with using open networks, and you expressly assume those risks.

No warranties

The Services are provided "as is" without warranty of any kind. CerTracker disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Services will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, CerTracker will not be liable for any incidental, special, exemplary, or consequential damages. In jurisdictions where liability cannot be excluded, CerTracker's total liability is limited to $100. Any claim must be brought within one (1) year of the event giving rise to it.

You agree to indemnify, defend, and hold harmless CerTracker and its representatives from any liability, loss, claim, suit, damage, and expense (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Services or any breach of these Terms.

We welcome feedback at support@certracker.com. By submitting feedback you grant CerTracker a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use it for any purpose.

If you breach these Terms, we may suspend or terminate your access without prior notice. To terminate your own account, email support@certracker.com and discontinue use of the Services.

Most concerns can be resolved by emailing support@certracker.com. If informal resolution fails, disputes will be resolved through binding arbitration before a single arbitrator under the rules of the American Arbitration Association and the laws of the State of Oklahoma, without reference to its conflict-of-laws provisions.
